Nina Mercedez Dist. deal with Hustler

Porn Valley- LFP Video Group has signed a distribution deal with Nina Mercedez’s company, Heartbreaker Films.

Under the agreement, Heartbreaker Films will produce 12 titles for LFP, all of them directed by Nina Mercedez or Raymond Balboa, President of Heartbreaker Films. Additionally, six of the 12 titles will star Nina Mercedez.

The one-year DVD distribution deal gives exclusive worldwide distribution rights to LFP, including HUSTLER TV broadcast rights. LFP and Heartbreaker Films hope to release their first title in early 2007.

Mercedez, a former Vivid girl, has a long history with Larry Flynt Publications. “The first photo of me ever published was in HUSTLER’s Beaver Hunt Magazine,” says Mercedez. “I feel like HUSTLER, from the very start, has believed in and stood behind me, and it feels right to come full-circle.”

Mercedez and Balboa’s move to LFP was an easy choice for both. “There was never any doubt,” says Balboa. “HUSTLER was the only phone call I made. Scottsdale Voters Siding with Strip Clubs

Scottsdale [East Valley Tribune] - Scottsdale voters apparently handed the city's two strip clubs a victory Tuesday by overturning a City Council decision to further regulate the businesses. Proposition 401 was losing by more than 1,300 votes, with an unknown number of early and provisional ballots left to be counted, according to preliminary results released Tuesday night.

The apparent defeat of Proposition 401 — a "no" vote was one against the tougher regulations — means the current rules will remain in effect for Babe's Cabaret, which is partially owned by adult film mogul Jenna Jameson, and Skin Cabaret, owned by local businessman Todd Borowsky [pictured left].

Club owners said the new regulations, which would have required a distance requirement for topless dancers and banned lap dances, would have driven them out of business.

The clubs gathered enough signatures to force a referendum on the changes the council approved in December, shortly after Jameson announced she was part owner of Babe's.

"This is 100 percent on (Mayor) Mary Manross," Borowsky said. "It was her pet project to do it this way. She did not want to listen to the businesses."

While patrons at Babe's cheered when television news stations showed the club leading at the polls, Yes on 401 supporters declined to concede and said voters were confused and provided with misinformation.

Mayor Mary Manross, who arguably was the leading proponent of the new regulations, said there were a variety of reasons for the vote — confusion over what a "no" vote meant, the wide gap in campaign spending and the spreading of incorrect facts about the council's process of approving the new rules. She did not see it as a vote against the council.

"There was an enormous amount of misinformation and false information circulated by the two businesses," Manross said. "It was very difficult for any organization or community to combat that."

Manross said the council will discuss its next step once the final results are in.

There were 19,223 early ballot requests among Scottsdale voters, with 8,581 counted as of Tuesday night. The No on 401 side was ahead on early ballots by seven votes, 4,294 to 4,287. It's unknown how many early ballots remain to be counted, Scottsdale City Clerk Carolyn Jagger said.

"We remain cautiously optimistic but we understand the numbers," said John Nichols, chairman of the Yeson401.com coalition.

Nichols said he respects the voters, but also chalked a lot of the results up to confusion.

"I talked to any number of voters that thought a 'no' vote was a positive vote for us and may have misunderstood," Nichols said.

Scottsdale residents who voted "no" told the Tribune their decision was primarily based on the City Council's handling of the situation and the belief council members should not be overregulating business, even ones they may not personally support.

"I didn't want Big Brother legislating morality," said Roc Leatherbury.

The voters who supported the stricter regulations told the Tribune the clubs were the type of business that justified the council's actions.

"Usually I support free enterprise, but I guess this time I made an exception," Linda Weber said.

The campaign became a battle between the clubs and local churches and neighborhood activists. The Yes on 401 coalition, led by the Christian conservative Center for Arizona Policy, couched the election as a vote for morality, safety and the city's quality-of-life. They collected less than $7,000, according to the last campaign finance statement, but had a number of high-profile endorsements from politicians and church leaders.

The No on 401 group — which was basically limited to Babe's and Skin and had well in excess of $200,000 in contributions — said this issue was not about whether voters like strip clubs, but whether a City Council has a right to change the rules to hurt an existing small business.

Maker of 'Girls Gone Wild' Runs Afoul of Law on Minors

Los Angeles CA [LA Times] - Joe Francis and the Santa Monica-based company he built on soft-core "Girls Gone Wild" videos pleaded guilty Tuesday to violating federal laws designed to prevent the sexual exploitation of children and agreed to pay fines totaling $2.1 million.

Under the terms of a deal with the Justice Department, Francis agreed to personally pay a $500,000 fine to settle charges in Los Angeles that he failed to keep records of the ages and identities of the women who appeared in his films. As a result, Francis said in a statement, footage of minors engaging in sexually explicit conduct appeared in at least two DVDs he released.

The videos, which feature young women exposing their breasts and engaging in other racy activities, are sold through late-night advertisements on cable television. Francis' company, Mantra Films Inc., takes in an estimated $40 million a year from the sale of videos such as "Ultimate Spring Break, Vol. 4" and "Girls Gone Wild on Campus Uncensored," according to people familiar with his business.

The 33-year-old entrepreneur, the subject of a Los Angeles Times magazine cover story last month, has come under mounting scrutiny for his personal and business conduct.

As part of Tuesday's pact, Mantra Films agreed to pay $1.6 million in fines and restitution to settle similar charges in a separate case in Florida. Mantra pleaded guilty in U.S. District Court in Panama City, Fla., to 10 counts of breaking federal record-keeping and labeling laws for sexually explicit material.

MRA Holdings Inc., another company owned by Francis, entered into a so-called deferred prosecution agreement under which the government would dismiss all charges if MRA abided by the accord for three years. MRA must hire an outside company to monitor its records and production facilities to ensure compliance with federal law.

"Today's agreements ensure that 'Girls Gone Wild' will comply with an important law designed to prevent the sexual exploitation of minors and puts other producers on notice that they must be in compliance as well," Assistant Atty. Gen. Alice S. Fisher said in a statement.

Francis could have faced more severe punishment including jail time had he not reached the Justice Department settlement.

Aaron S. Dyer, a lawyer for Francis and his companies, said Mantra changed its business practices before the Justice Department launched its investigation.

"The company has already implemented the procedures necessary both to ensure that they have the appropriate records and to comply with the agreements," Dyer said.

In legal statements filed Tuesday, the companies acknowledged that throughout 2002 and part of 2003, it filmed, produced, and distributed sexually explicit materials in violation of record- keeping and labeling laws. Those laws require producers not only to maintain proof of age and identification for performers, but also to carry labels on their videos saying where those documents can be found.

"We regret that this occurred and will make sure that no other minors are used in 'Girls Gone Wild' films," Francis said in his court statement.

Since 1998, Francis has built a business around spring-break revelry and youthful hedonism. The company has released dozens of "Girls Gone Wild" films featuring real footage of young women, often intoxicated, bouncing around bars and beaches and flashing their breasts for the cameras.

A portion of the evidence used by the Justice Department investigation that resulted in Tuesday's guilty pleas came from a separate case filed in Panama City in 2003. The state attorney's office filed a 77-count complaint in Florida circuit court that alleged that Francis and his crew took a 16-year-old girl and four 17-year-old girls to a motel and paid them to engage in sexual conduct with one another in a shower in front of his cameras. He also paid two of the girls $50 each to engage in sexual actions with him, according to the complaint. Authorities seized film footage, Francis' Ferrari and his personal jet.

Francis pleaded not guilty to all charges. After a judge last month suppressed all the evidence, saying it was illegally obtained, Dyer said he would seek to have the case dismissed. He said Tuesday's agreement would have no bearing on the state criminal case in Panama City.

Also pending is a civil case alleging child abuse and sexual exploitation, which was filed against Francis, his crew and his company by the parents of the young women in Panama City.

Based on evidence seized in Panama City, federal investigators stepped in and obtained a search warrant for Mantra Films' Santa Monica office. The FBI has confirmed that it conducted a search of Francis' offices in September 2005.

This is not the first time Francis has been in the cross hairs of the federal government over his business practices.

In 2004, Francis and Mantra Films agreed without admitting guilt to pay a $1.1-million penalty to settle a complaint by the Federal Trade Commission that alleged the company had enrolled customers in its video-buying programs without their knowledge and had misrepresented a money-back guarantee.

This summer, a lawyer for Francis said "the company made a business decision to resolve the matter rather than incur the substantially greater legal fees necessary to successfully defend the matter."

Francis also has been criticized for his involvement with young women during the filming of his videos.

The Times magazine article reported that Francis had had sex with an 18-year-old woman in Melrose Park, Ill., after a nightclub event sponsored by "Girls Gone Wild." The incident took place in a "Girls Gone Wild" tour bus, one of two that crisscross the country to promote the brand and gather footage of female revelers.

Jannel Szyszka alleged that on June 1 Francis gave her alcohol and brought her onboard a bus to be filmed — with her consent. She alleged that Francis then forced himself on her even though, she said, that she him to stop. Francis denied any wrongdoing, but said through a representative that he had had consensual sex with Szyszka.

In August, Szyszka reported the incident to the police. Lt. Michael Castellan, head of investigations for the Melrose Park Police Department, said the investigation was ongoing.

Dyer said Tuesday that "the claims made by the woman in Melrose Park were not true."

MIAMI (Reuters) - A Florida diver shot a large grouper with a spear gun then apparently drowned when the fish sped into a hole, entangling the man in the line attached to the spear, investigators said Monday.

The 42-year-old man, whose name was withheld, was free-diving in about 25 feet of water off the lower Florida Keys Saturday and speared a Goliath Grouper, Monroe County Sheriff's Detective Mark Coleman said.

"It looks like the fish wrapped the line attached to the spear around the victim's wrist. The fish then went into a hole in a coral rock, effectively pinning the man to the bottom of the ocean," Coleman said in a news release.

Police divers found the speared fish tightly wedged into the hole, with the man's body still tangled in the line, a sheriff's spokeswoman said.

Goliath Grouper are the largest members of the sea bass family and can weigh hundreds of pounds.

Malaysian wants to marry 10 prostitutes

KUALA TERENGGANU (UPI) -- A Malaysian man says he's willing to marry 10 aging prostitutes -- one a great-grandmother -- if they promise to be monogamous.

The 54-year-old widower in Kuala Terengganu wrote to several government agencies making the offer after reading older prostitutes in Kampung Tiong were struggling financially because their services were less in demand, the Malaysia Star reported.

"I don't care who they were previously," he said. "But if I marry them, they should be loyal to me alone and take good care of me as their husband."

He said all the women would be treated equally under his roof and "we can all live happily ever after."

Datuk Rosal Wahid, state Islam civilization and welfare committee chairman, said the government had no objection -- if the proposal is sincere.

He also suggested the prospective groom "not be overzealous and just marry one woman first."
